Smokefree homes and family cars

Nevertheless, people are today most likely to be exposed to the harmful effects of secondhand smoke in their own homes and private motor vehicles. Even though more people are making their own homes smokefree, far too many people continue to be exposed to secondhand smoke at home.We want to encourage people to create home environments where smokers no longer expose their families to secondhand smoke.
We will support local areas to work in partnership across their communities to encourage smokers to change their behaviour so that they do not smoke in their homes or family cars. rather than extending smokefree legislation, we want people to recognise the risks of secondhand smoke and decide voluntarily to make their homes and family cars smokefree.We will encourage local areas to create networks of local smokefree ambassadors at a community level to encourage people to make their homes and family cars smokefree.We will support local efforts to raise awareness and use behavioural change insights, for example around building positive social norms and through positively recognising people who protect their families and other people from secondhand smoke in their homes and family cars.
To support local efforts, we will work with national media to raise awareness of the risks in exposing children to secondhand smoke. The department of Health’s new marketing strategy for tobacco control will set out further details of how we will support efforts by local areas to encourage smokefree homes and family cars.

Classifi cation of drugs in the Act

We also have to work on the classifi cation conundrum: what are the boundaries between A, B and C? Can we come up with some absolute measures that would, in future, allow us to say this drug is A because of this or B because of this. One thing’s for sure: at present, experts and politicians don’t agree, which is why I think the public debate needs to begin. Who do the public trust more – the experts or the politicians?

When we look at the discussion that we had about ecstasy (where the ACMD recommended class B (Nutt et al., 2009) and the government maintained it as A), I think there’s very little doubt that we, the scientists, won the intellectual argument, but we obviously didn’t win the decision in terms of classifi cation. Any agreement will be diffi cult if we’re not talking in the same language about the same relative measures of harm; this is what I am trying to address in this talk.

“I’ll stop after the next pack, next carton, next month, my next birthday or New Years’ day” - Oh really? Can you count on both hands and all your toes how many times you’ve lied to yourself with such nonsense? And which pack, carton, month or birthday will give you the best chance for success? Why did I limit myself to always purchasing only a one-day’s supply? Because tomorrow was always going to be quitting day and I couldn’t see me throwing away a carton. · “I don’t even know if I’m hooked, I’ve never tried stopping” - Some of us never made a serious recovery attempt, but why? What easier way of never having to admit chemical dependency or experience defeat than pretending that evidence of a problem simply doesn’t exist? · “I’ll stop next week” - Some of us pretended that we’d be quitting soon. Some went so far as to actually set a date. Doing so would always make today’s nicotine fixes far more tolerable. · “I’m waiting on a painless quitting cure” - Don’t hold your breath. The day science can make our mother’s death painless, so as to avoid our sense of emotional loss, is the day it will be capable of erasing the emotional loss associated with ending the most dependable chemical relationship we’ve likely ever known. · “The vaccines are coming!” - The next generation of pharmaceutical products will be the vaccines. Four to five vaccine shots over six months will cause the body’s immune system to create large antibodies which quickly bond with nicotine molecules, making them too large to cross through the blood-brain protective filtering barrier and stimulate dopamine pathways. The problem appears to be that there are simply not enough antibodies and up to one-third of nicotine fails to bond and crosses the blood-brain barrier. Early reports suggest that more than 80% of vaccinated participants are relapsing to smoking within 9 months.

Bad breath and nasty tastes

Healing senses of smell and taste may find it hard not to notice horrible odors and tastes rising-up from healing lungs or oozing from tobacco marinated gums and mouth tissues. Guess what? This is what it was like inside your mouth while still using but your senses were so dulled by tobacco toxins that they couldn’t notice.

Picture layer after layer of cells slowing dying and being replaced. Depending upon how long, frequently and intensely we used tobacco it could take some time for these tastes and odors to fully dissipate. Continued healing, time, oxygen rich blood, and fluids will keep mouth, nasal, throat and respiratory tissues on the road to maximum recovery. Brushing a bit more frequently and mouthwash should help control any odors released from slowly healing tissues.

Emotional Readjustment

Although chemical in nature, a long and intense relationship is ending. For many of us it was the most dependable relationship we’d ever known. If our fix was bummed or borrowed, we may not have liked the flavors accompanying it, the time needed to produce the desired effect or the degree of control over the precise amount that arrived in our brain.

But never once did nicotine let us down. Once inside our bloodstream, within seconds we experienced replenishment: arrival of nicotine’s high and a stimulated dopamine “aaah.” But now that’s all behind us. It’s over, finished, done. And as with ending any long-term relationship we must navigate the sense of loss emotions flowing from it. Denial, anger, bargaining and depression, each emotion overcome brings us closer to acceptance, the finish line marking completion of emotional recovery.

“I like it” - “I love it”

I used to say this too and believed this rationalization with every fiber of my being. Think hard, what is it that you love about smoking or using oral tobacco? If a smoker, what is so wonderful that we are willing to damage and even destroy our lungs and gradually clog every artery in our body, while accepting a 50/50 chance of departing earth more than 5,000 days early? If an oral user, how much love does it take to permanently expose your mouth to unadulterated tobacco’s 2,550 chemicals? Joel teaches that as dependent users we live a constant struggle to maintain a narrow range of nicotine in our bloodstream, referred to as our “serum nicotine level.”

Each time our serum nicotine level falls below our minimum limit we begin sensing the onset of symptoms of early withdrawal. We start growing tense, anxious, irritable, and depressed and the only thing that will bring us immediate relief from escalating symptoms is more nicotine. Once replenished, we are left totally convinced that we "enjoy smoking,” "like chewing” or “love our dip.” On the other end, we also have to be cautious not to use too much nicotine and exceed our upper limit of tolerance or we risk suffering varying degrees of nicotine poisoning.

Early symptoms can include a sick feeling, nausea and dizziness. As Joel notes, being a successful user is like being an accomplished tightrope walker, constantly maintaining a balance between these two painful extremes of too much or too little nicotine.103 According to Philip Michels, PhD, a USC School of Medicine professor and cessation facilitator, it is normal for us to look to our own behavior in order to obtain clues about our attitudes and beliefs. We tend to draw conclusions about what we must like by watching what we see ourselves doing. Such self-analysis goes like this:

DEMAND FOR TOBACCO LEAVES

Most of the tobacco produced in the world is not consumed as a final consumer product, but is used to produce tobacco products. Cigarette production accounts for most of the tobacco use in the world. In the United States, for example, cigarette production utilized 90 percent of the total tobacco consumed in 1996 (USDA, 1996). Other products include smokeless tobacco and cigars.

Demand for tobacco is primarily derived from consumer demand for cigarettes. Thus, factors influencing demand for cigarettes would also affect the demand for tobacco. These factors will be discussed in the later section on demand for cigarettes. Cigarette manufacturers use tobacco and other inputs to produce cigarettes. An important question in determining the factors affecting demand for tobacco is whether there exists a substitutable relationship between raw tobacco and other production inputs.

Sumner and Alston (1987) examined this question using a generalized Leontief cost function with data from United States cigarette production. Their results showed that utilization of United States-grown tobacco was not a fixed proportion of cigarette outputs. Both imported tobacco and other inputs were substitutes for United States produced tobacco. The estimated output-constant price elasticity of demand for United States tobacco was -2.3. The cross-price elasticity of demand for imported tobacco with respect to the price of United States tobacco was 2.0. Substituting tobacco for the other production inputs according to their study occurred in two different forms: increasing the proportion of additives to cigarettes and reducing tobacco wastage.

These substitution processes were accomplished through developing new production technologies. The leaf-conserving technology had increased the filling capacity of tobacco. Other technology also permitted the use of the entire leaf. Because of this substitution, the amount of tobacco used to produce 1000 cigarettes had fallen from 2.70 pounds in 1950-54 to 1.70 pounds in 1987 (Sumner and Alston, 1987).

Effects of the anticompetitive combination to prevent the violation

Even those courts that would allow some version of disgorgement under section 1964(a) recognize that the statute is limited to preventing future violations and does not extend to future effects flowing from past violations.

The condition of monopolization is itself a violation of the Sherman Act, 15 U.S.C. §§ 2, 3, therefore district courts may order remedies to cure the monopolizing effects of the forbidden anticompetitive combination or acquisition so as to prevent the continuing violation, id. § 4. The same is not true of RICO or the fraud statutes, under which any future violation would have to result from ongoing acts, not ongoing conditions.

Defendant BATCo claims that the district court erred in 53 imposing liability on the basis of its conduct outside the United States. Noting that the district court found that its “activities and statements took place outside of the United States,” Philip Morris, BATCo claims that it enjoys immunity from RICO liability because the statute has no extraterritorial reach. We need not decide today whether RICO has true extraterritorial reach—that is, whether it could reach foreign conduct with no impact on the United States—because the district court found BATCo liable on the theory that its conduct had substantial domestic effects.

Because conduct with substantial domestic effects implicates a state’s legitimate interest in protecting its citizens within its borders, Congress’s regulation of foreign conduct meeting this “effects” test is “not an extraterritorial assertion of jurisdiction.”  Thus, when a statute is applied to conduct meeting the effects test, the presumption against extraterritoriality does not apply.

Off On Proposed Smoking Ban

Westfield residents on Monday got their first chance to sound off before city council on a proposed comprehensive smoking ban.

"This is just a place for those people who choose to do that and be around that," Foust said. "I believe there are plenty of places for people to go who don't choose to do those things."Several residents expressed anger that the council would even consider a comprehensive ban."When you eliminate that opportunity, they're not going to stop smoking. They're just going to go somewhere else," said one man.Helen Lee, a smoker, said snuffing smoking at restaurants and sports venues is going too far."If you want to smoke, you should be able to smoke," she said. "They can make non-smoking bars and smoking bars."On the other side of the issue, several people spoke in favor of the ban, most citing health concerns."No one should have to choose between their health and their paycheck," said one woman.

Some said the issue is protecting workers in smoking environments from secondhand smoke, and some shared personal stories."I was raised, basically, on secondhand smoke," said Sheila Wheeler, a cancer survivor. "My parents both smoked. As a result, I hand cancer three times before I was 35 years old."Council members heard public comments Monday night, but didn't weigh in themselves.The council said it will consider the public's voice and may hold more hearings. A vote is not yet scheduled.

The tobacco defendant manufacturers

The government presented evidence from the 1950s and continuing through the following decades demonstrating that the Defendant manufacturers were aware—increasingly so as they conducted more research—that smoking causes disease, including lung cancer. Evidence at trial revealed that at the same time Defendants were disseminating advertisements, publications, and public statements denying any adverse health effects of smoking and promoting their “open question” strategy of sowing doubt, they internally acknowledged as fact that smoking causes disease and other health hazards.

Although the manufacturers conducted their own research and public relations regarding health and other issues, they also relied in part on a series of jointly-created entities. Among these entities were Defendants TI and CTR (formerly the Tobacco Industry Research Committee).

The Defendant manufacturers created TI and CTR, composed their membership, staffed their boards of directors with executives from the manufacturers, and maintained frequent communication between high-level manufacturer and joint-entity officials. Evidence at trial showed that TI and CTR conducted the manufacturers’ joint public relations through false and misleading press releases and publications, trained representatives from the manufacturers regarding their coordinated industry message, conducted some cigarette testing for the manufacturers, and funded “special projects” to produce favorable research results and witnesses specifically for use in litigation and for support of industry public statements

For the second year running, RJR-Macdonald is using women celebrities to push its second-leading brand, Vantage cigarettes. The first Vantage Women of Originality Awards were presented to four Canadian women on May 7, 1998. A second round is set for June 1999. The 1998 winners were: singer-songwriter Jann Arden, fashion entertainer Jeanne Beker, figure skating choreographer Sandra Bezic and comedian Mary Walsh. In return for accepting these awards, the award-winning women receive a profile in a major women’s magazine, and a donation of ,000 to a woman’s charity of their choice. Other benefits are not disclosed.

The benefits to the tobacco company are more obvious. This promotion is a way for Vantage to escape restrictions on tobacco advertising, including restrictions on celebrity endorsements. This year’s advertisements are accompanied by a response form, which asks readers for their opinions on what originality means to them. It invites respondents to answer ’yes’ or ’no’ to statements like "I have a way about me that is all my own," or "I think of myself as being a creative person" and to mail the results to RJR’s marketing division, along with information about their age and income. -- Not surprisingly, names and addresses are also collected. Big isn't it?

Without careful scrutiny this ’Big isn’t it’ ad is unlikely to reveal much. But, take note of the arrow on the roadway sign in the centre of the ad. Follow it upwards towards the cliff face. There you will find a carved figure, exceedingly weather worn, but still revealing some of the characteristics of a huge statue. There are actually two such figures. These are highlighted in the rollover image. It is relatively easy to see the toes or claws of the figure on the right of the enlargement. Towards the top of the cliff face is the face. Halfway up, in the genital area of the statue, is a huge, pineapple shaped erection. Big isn’t it? If one wished to follow through the connotations associated with this ad it would take a full five pages. Here is rather humorous one as a starter. There are a pair of statues, they are big. What is the usual common colloquial meaning attached to the phrase ’A Big Pair’?

Additionally one can note that the first figure has an upraised left arm. Furthermore it has an upraised digit finger. Is the ’up yours’ sign intended to be a prime indication of what Philip Morris and their ad agencies think of Marlboro smokers? Or is it one of the artists taking the mickey out of their employer?

Who knows! The ’Big isn’t it’ ad was published a number of time. This would seem to indicate it was a commercially successful ad. Sometimes the scene in the ad was a mirror image of the ad above. The small illustration on the right shows one of the mirror images of the scene presented in the ad commented on above. Comparing the different versions of the ad indicates that artistic alterations were made to whatever was the original. Outcrops of rock appear - and disappear. Artistic ’blasting’ or ’major reconstructive surgery’ apparently took place on the left hand side of the bluff in this instance.

Such constructive efforts undoubtedly helped when the creative artists responsible turned their mind to a real construction scene, as depicted in the ad on the left. Again, this is a ’sexy’ ad if you are aware of, or respond to, the cues that direct your attention. Just as the arrow on the road sign in the ’Big isn’t it’ ad led one to the statue, so the alignment of the cigarette pack, and the architects plans, in this ad directs attention towards the little individual shown in the picture on the right. This steelworker has the great granddaddy of all ’erections’. Proportionally his pecker outstrips that of the statue on the cliff face. Big isn’t it? The ads creators would no doubt argue that the alignment of the pole and the steelworker was coincidental. What do you think? Tax increase on cigarettes

Colorado's House Finance Committee passed a bill Tuesday that could result in what some Republicans are alleging amounts to an unconstitutional tax increase on cigarettes.

On a 6-5 party-line vote, the committee approved House Bill 1342, legislation specifically seeking to repeal a current exemption of cigarette packs from the state sales tax.

Under the state's current tax structure, the only statewide tax on cigarette packs comes from an 84 cent per-pack excise tax, with revenue going to benefit educational and health programs. In addition, many local governments maintain the authority to charge local sales taxes on such purchases.

If passed, HB 1342 would come on the heels of a federal tax increase on cigarettes earlier this year, which increased the cost of a pack of cigarettes by 62 cents. According to Boston medical researcher and writer Mac Johnson, cigarette prices increased 154 percent between 1980 and 1990, "thanks in large part to increases in federal, state, and local taxes."

While debates surrounding smoking are often contentious, committee member Rep. Kent Lambert, R-Colorado Springs, says that the bill is about more than the million in additional revenue it could bring into the state.

"The plain and clear language of the [Colorado] Constitution says this is against the law," Lambert told Face the State, arguing that the bill's passage would signal a violation of the constitution's Taxpayer's Bill of Rights, which requires that any tax increase must go to a vote of the people.

Democrats have introduced multiple legislative efforts to raise revenue without resorting to a vote on specific taxes or fees, emboldened by the Colorado Supreme Court's recent ruling on a 2007 property tax increase. The ruling has been interpreted by General Assembly lawyers as to condone the removal of tax credits, since the resulting increase in revenue would not exceed any currently applicable constitutional tax limits. Voters temporarily waived the state's TABOR limit in 2005 with the passage of Referendum C.

According to Mike Saccone, spokesman for Attorney General John Suthers, Suthers has not taken a position on HB 1342.

Lambert led a Facebook campaign this week encouraging his constituents to contact fellow committee members for a "no" vote. The effort fell short, with fellow Colorado Springs Rep. Dennis Apuan, a Democrat and a swing vote on the committee, voting to refer the bill to Appropriations. Apuan was not immediately available for comment.

HB 1342 has not yet been scheduled in the House Appropriations Committee, but is expected to be heard later this week.

Smoldering cigarettes are a burning issue

An Elm Street woman butted her cigarette against the side of her house and put it in a plastic garbage bag Sunday afternoon.

Her house caught fire a short time later.

Monday, someone threw a lit cigarette against the side of the outside wall at Burger King. The corner of the wall caught fire and the fire traveled into an enclosed space, smoldering until the flames broke free.

It was the third time in less than a week that local fire companies had to contend with fires caused by smoldering cigarettes.
Medina firefighters were called to 1025 Elm St. about 5 p.m.

Sunday. Public Information Officer Jeffrey Elsenheimer said fire crews found fire in the wall of the enclosed porch. They were able to quickly extinguish the fire and prevent it from extending into the house, Elsenheimer said.

An investigation revealed the homeowner put the cigarette in the plastic garbage bag, where it smoldered before sparking a fire in the plastic garbage can.

About 24 hours later firefighters were called to Burger King on Maple Ridge Road for a fire in the bathroom. Smoke was coming from the outside wall and in both restrooms, Elsenheimer said.

Firefighters used hand tools to wrench open the ceilings and walls in both bathrooms but were unable to find the source of the fire.

An exterior wall was then cut open and the fire was found in a concealed stud space, Elsenheimer said.

The fire was put out and the outside corner of the building and walls in the women’s bathroom had to be removed. The restaurant remained closed this morning.


Several cigarette butts were found outside the entrance.

Elsenheimer said restaurant patrons often discard their cigarettes before entering and likely one of those cigarettes ignited the outside corner of the building.

Shelby and Lyndonville firefighters assisted Medina.

Thursday, careless smoking caused a fire at the former Pizza Pantry in Corfu. Two firefighters were injured battling the fire.

"Obviously the best way to prevent fires linked to cigarette smoking is to quit," Elsenheimer said. "We realize that is very difficult for most people so by following a few simple safety tips, you can help decrease your chances of a smoking-related fire."
